To the abbot of Whitby. Whereas, as the king has heard, the abbot caused the goods and chattels of John de Irton’, lately deceased, to be taken into the king’s hand because John had once been coroner within the abbot’s liberty of Whitby Strand, and whereas the executors of the testament of the said deceased have offered sufficient security to him on several occasions for keeping him [the abbot] indemnified towards the king and certain others for debts if John owed anything to the king or to any other whatsoever on the day he died by reason of the aforesaid office, the abbot refuses to admit the aforesaid security and does not permit the aforesaid executors to have administration of the aforesaid goods. Because the king wishes to pursue the pious promises of the departed by the favour of goodwill, as the king is bound to, command that, if this is so and the aforesaid executors shall find the abbot twelve trustworthy and law-worthy men who might answer and satisfy for the debts if the said deceased owed anything to the king or to others by the aforesaid reason on the day he died, then he is to permit them to have full and free administration of all goods and chattels of the said deceased in his hand, in order to make execution of the aforesaid testament therefrom, as is incumbent upon him, and he is to behave in such a manner in the foregoing that the king ought not apply a hand of correction to him otherwise by reason of his default. 1
