1 June. Westminster. Concerning the lands of John fitz John to be taken into the king’s hand. To the sheriff of Hampshire. Whereas John fitz John lately before the disturbed state of the realm had performed his homage to the king for all the lands and tenements which John fitz Geoffrey, his father, held of the king in chief on the day he died and which fell to the same John by hereditary right, and whereas, afterwards the king, by reason of the trespasses made against him by the same John, and of which he was accused, the king had given all the lands and tenements aforesaid to his beloved and faithful Gilbert de Clare, earl of Gloucester and Hertford, to have to him and his heirs, saving to the chief lords of that fee, either to the king or others, his homages and reliefs and other things that pertain to the king and his heirs by reason of the lands and tenements which are held from him in chief, and whereas, later, the king submitted himself to the ordinance and dictum of the venerable father O. Cardinal Deacon of St. Adrian, legate of the Apostolic See, and certain others of the king’s faithful men concerning lands of those disinherited that had been granted away by the king, who thus ordained at Kenilworth that those who had been against the king at the time of the aforesaid disturbance should redeem their lands and tenements for five years, as is more fully contained in the aforesaid dictum of Kenilworth, and whereas the aforesaid earl returned his lands and tenements to the same John by the form of the aforesaid dictum, and John performed his homage to the said earl for all of his lands and tenements, to the disinheritance of the king and his heirs and contrary to the grant which the king had made to the same earl concerning the same lands and tenements, for which the king caused John to come into his court (in Curia sua), and whereas he appeared before him in person and the king firmly enjoined upon him that he was to perform his homage to him for the same lands and tenements and that he then received a certain day upon which to perform his homage for them, John cared not to come at that day in contempt and to the manifest disgrace of the king, order to take all lands and tenements of the same John in his bailiwick into the king’s hand and to keep them safely until the king orders otherwise, so that he answers the king at the Exchequer for the issues arising therefrom. He is to omit nothing in this just as he loves himself and his possessions.
